REFUND & CANCELLATION POLICY

Data Ikseer is committed to delivering high-quality data services and ensuring client satisfaction. This Refund & Cancellation Policy outlines the circumstances under which refunds and cancellations are possible, as well as the procedures for processing them.

This policy applies to all services provided by Data Ikseer, whether engaged directly through the website (https://dataikseer.com), via email/WhatsApp, or through freelance platforms such as Upwork and Fiverr.

1. Cancellation Policy

1.1 Cancellation by Client

Clients may cancel project engagements at any time by providing written notice via email to contact@dataikseer.com, WhatsApp at +92 311 1031453, or through the freelance platform messaging system (Upwork, Fiverr).

1.2 Cancellation Before Work Begins

If a client cancels before Data Ikseer has started any work on the project (i.e., before any analysis, processing, coding, or deliverable creation has begun), the client is eligible for a full refund of any payments made, minus transaction or processing fees charged by payment platforms such as PayFast (2.9% + PKR 2.50), Upwork (3-5%), or Fiverr (5.5%).

1.3 Cancellation After Work Begins

If a client cancels after work has begun, the client will be charged for the work completed up to the cancellation date. The amount will be calculated based on:

  • Percentage of project completion (e.g., if 40% of the project is complete, the client will be charged for 40% of the total project cost)

  • Hours worked at the standard hourly rate of PKR 3,000 per hour (approximately USD 30 per hour), whichever is applicable based on the Service Agreement

Any remaining balance after deducting the cost of completed work will be refunded to the client within 14 business days via the original payment method.

1.4 Non-Refundable Deposits

Initial deposits (typically 50% for large projects) paid at the start of a project are non-refundable unless Data Ikseer has not begun any work on the project. This deposit secures the project slot in the Data Ikseer schedule and covers initial planning, research, and setup time.

2. Refund Policy

2.1 Eligibility for Refunds

Refunds may be issued in the following circumstances:

  • Service Not Delivered: If Data Ikseer fails to deliver the agreed Services or deliverables within the specified timeline without valid justification (such as client-caused delays), the client is eligible for a full refund

  • Major Quality Issues: If the delivered work contains major errors or does not meet the specifications outlined in the Service Agreement, and Data Ikseer is unable to correct these issues through the agreed 2-3 revision rounds, the client may be eligible for a partial or full refund

  • Duplicate Payment: If a client accidentally makes duplicate payments, the extra amount will be refunded in full within 7 business days

2.2 Ineligibility for Refunds

Refunds will NOT be issued in the following circumstances:

  • Change of Mind: Once work has begun, refunds will not be issued simply because the client has changed their mind about the project or no longer requires the Services

  • Subjective Dissatisfaction: Refunds based on personal preferences or subjective opinions (e.g., "I don't like the color scheme") are not provided if the work meets the agreed specifications and industry standards

  • Client-Caused Delays: If project delays are caused by client failure to provide necessary information, data, files, or timely feedback, no refund will be issued

  • Completed Projects: Once the project is completed, delivered, and approved by the client (either explicitly or implicitly by accepting final deliverables), no refunds will be issued

  • After Revision Period: Refund requests made after the 14-day revision period has expired will not be accepted unless there are extenuating circumstances

2.3 Partial Refunds

In cases where some work has been completed but the client is not satisfied with the final deliverables despite multiple revision rounds, a partial refund may be offered at Data Ikseer discretion. The refund amount will be based on the value of the work completed, accepted deliverables, and hours invested.

3. Refund Request Process

3.1 How to Request a Refund

To request a refund or cancellation, clients should follow these steps:

  • Step 1: Contact Data Ikseer via email at contact@dataikseer.com or through WhatsApp at +92 311 1031453 with the refund request

  • Step 2: Include project details (project name, invoice number, payment date, payment amount, and detailed reason for the refund request)

  • Step 3: Data Ikseer will review the request and respond within 3-5 business days with a decision and the next steps

3.2 Refund Processing Time

Once a refund is approved, it will be processed within 14 business days. The refund will be issued to the original payment method used for the transaction:

  • Bank Transfer: Refunds will be credited back to the client bank account within 5-10 business days after processing

  • PayFast: Refunds will be processed through PayFast and credited to the client account within 7-14 business days depending on the bank

  • Upwork/Fiverr: Refunds for projects completed through freelance platforms will be processed according to the platform's refund policies and timelines (typically 5-14 business days)

Please note that Data Ikseer is not responsible for delays caused by banks, payment processors, or freelance platforms beyond Data Ikseer control.

4. Freelance Platform Refund Policies

If a client hired Data Ikseer through a freelance platform (Upwork or Fiverr), the platform's refund and dispute resolution policies will also apply. In the event of a dispute:

Upwork: Disputes can be escalated to Upwork's dispute resolution team. Upwork may hold funds in escrow and mediate between both parties to reach a fair resolution

Fiverr: Fiverr offers a resolution center where clients can request refunds or modifications. Fiverr's customer support team will review the case and make a final decision based on their Terms of Service

Data Ikseer strongly encourages clients to contact Data Ikseer directly first to resolve any issues before escalating to the platform, as Data Ikseer is committed to client satisfaction and fair resolution.

5. Exceptions and Special Circumstances

In exceptional circumstances, such as serious illness, family emergencies, natural disasters, or force majeure events that prevent Data Ikseer from delivering the Services, Data Ikseer may offer a full refund or reschedule the project at no additional cost.

Similarly, if a client experiences an unexpected circumstance that prevents them from continuing with the project (such as business closure, medical emergency, or financial hardship), the client should contact Data Ikseer immediately at contact@dataikseer.com. Data Ikseer will work with the client to find a fair solution, which may include rescheduling, partial refunds, project pausing, or installment payment plans.

6. Dispute Resolution

If a client is dissatisfied with a refund decision, the client is encouraged to contact Data Ikseer directly at contact@dataikseer.com or +92 311 1031453 to discuss the issue. Data Ikseer is committed to resolving disputes amicably through good-faith negotiation and finding mutually acceptable solutions.

If a resolution cannot be reached through direct communication within 30 days, disputes will be subject to the laws of Pakistan and the jurisdiction of the courts in Karachi, Pakistan, as outlined in the Data Ikseer Terms and Conditions.

7. Non-Refundable Items

The following are non-refundable:

  • Initial Deposits: Deposits (typically 50% for large projects) paid at the start of a project are non-refundable unless no work has been performed

  • Completed Work: Any deliverables that have been completed, delivered, and approved by the client (either explicitly or by accepting final files) are non-refundable

  • Revision Fees: Additional revisions requested beyond the agreed 2-3 revision rounds are non-refundable

  • Third-Party Costs: Any costs incurred for third-party services (e.g., cloud storage, software licenses, premium tools, payment processing fees) are non-refundable

  • Rush Fees: Any premium charges for expedited delivery or rush work are non-refundable once the work has been prioritized and scheduled

8. Changes to This Policy

Data Ikseer reserves the right to update this Refund & Cancellation Policy at any time to reflect changes in business practices or legal requirements. Changes will be posted on this page at https://dataikseer.com with an updated effective date. Continued use of Data Ikseer Services after changes constitutes acceptance of the revised policy.
