Data Ikseer – Data Services, Analytics, AI Automation & Cloud Solutions

These Terms and Conditions ("Terms") govern the use of the Data Ikseer website (https://dataikseer.com) and the data analytics, processing, automation, and visualization services ("Services") provided by Data Ikseer.

By accessing the Data Ikseer website, engaging Services directly, or hiring Data Ikseer through freelance platforms (Upwork, Fiverr), individuals and organizations agree to be bound by these Terms. If an individual or organization does not agree with any part of these Terms, they should not use the website or Services.

1. About Data Ikseer

Data Ikseer is a data services company founded by Abbas Huzefa Motiwala, an IBM and Microsoft Certified Data Analyst based in Karachi, Pakistan. Data Ikseer specializes in:

  • Data Processing and Automation using Excel, Google Sheets, and Power BI

  • Data Visualization and Dashboard Creation (Power BI, Looker Studio, Excel, Google Sheets)

  • Data Analytics (Marketing, Sales, Financial, Supply Chain, HR Analysis)

  • VBA, Apps Script, and Custom Automation Solutions

  • ETL (Extract, Transform, Load) Services and Data Engineering

  • Custom Software Development for Data Management

All Services are delivered digitally via email, cloud platforms (Google Drive, OneDrive, Dropbox), or file-sharing services. Data Ikseer does not provide physical products or shipping services.

2. Service Engagement and Scope of Work

2.1 Service Agreement

Each project engagement will be outlined in a separate Service Agreement, project proposal, or freelance platform contract that specifies deliverables, timelines, pricing, and revision limits. By accepting a proposal, making payment, or hiring Data Ikseer on Upwork/Fiverr, the client agrees to the specific terms outlined for that project.

2.2 Client Responsibilities

As the client, the individual or organization agrees to:

  • Provide accurate, complete, and timely information required for project completion

  • Grant necessary access to data files, cloud platforms, or systems as required for service delivery (with appropriate security measures in place)

  • Respond promptly to requests for clarification or approval to avoid project delays

  • Make timely payments as per the agreed payment terms

2.3 Data Ikseer Responsibilities

Data Ikseer agrees to:

  • Deliver Services with professional skill and care, in accordance with industry best practices

  • Meet agreed deadlines and milestones, provided that client information is provided on time

  • Maintain confidentiality of all client data (see Section 7)

  • Provide the agreed number of revisions as specified in the Service Agreement

3. Intellectual Property Rights:

3.1 Ownership of Deliverables

Upon full payment, the client owns the final deliverables (reports, dashboards, spreadsheets, scripts, automation solutions) created specifically for the project. The client may use, modify, and distribute these deliverables as they see fit for business purposes.

3.2 Data Ikseer Intellectual Property

All methodologies, templates, frameworks, proprietary processes, and pre-existing code libraries used by Data Ikseer remain the exclusive property of Data Ikseer. Clients may not reproduce, redistribute, reverse-engineer, or sell material from the Data Ikseer website or proprietary tools without prior written permission from Data Ikseer.

3.3 Client Data and Content

Clients retain all rights to any data, files, or content they provide to Data Ikseer. Data Ikseer processes client data solely for the purpose of delivering the agreed Services and does not claim ownership of client data.

3.4 Portfolio and Testimonials

With client consent, Data Ikseer may use anonymized or generalized descriptions of projects in portfolios, case studies, or testimonials. Data Ikseer will not disclose confidential or sensitive information without explicit client permission.

4. Payment Terms:

4.1 Pricing and Currency

All prices are quoted in Pakistani Rupees (PKR) or US Dollars (USD) as specified in project proposals or freelance platform contracts. Prices are exclusive of any applicable taxes unless stated otherwise.

4.2 Payment Methods

Data Ikseer accepts payments via bank transfer (direct deposit to Pakistani bank account), PayFast (for Pakistan-based clients), Upwork, Fiverr, or other mutually agreed payment platforms. Payment processing fees, if any, are the responsibility of the client unless otherwise agreed.

4.3 Payment Schedule

  • Small Projects (under PKR 50,000 or USD 500): Full payment is required upfront before work begins

  • Large Projects (over PKR 50,000 or USD 500): A 50% deposit is required before work begins, with the remaining 50% due upon project completion and delivery

4.4 Invoicing and Due Dates

Invoices are due within 7 days of issuance unless otherwise specified in the Service Agreement. Late payments may result in suspension of work, additional late fees of 2% per month, or cancellation of the project.

4.5 Additional Costs

Any services or revisions beyond the agreed scope will be billed separately at the standard hourly rate of PKR 3,000 per hour (approximately USD 30 per hour). Clients will be notified of additional costs before any extra work is performed.

5. Revisions and Amendments

Each project includes 2-3 rounds of revisions as outlined in the Service Agreement. Revisions must be requested within 14 days of project delivery.

Revisions are limited to corrections, adjustments, or refinements within the original scope of work. Requests for new features, additional reports, or changes to project requirements will be considered scope changes and billed separately.

Additional revisions beyond the agreed limit will be charged at the standard hourly rate of PKR 3,000 per hour.

6. Service Delivery and Timelines

6.1 Delivery Method

All deliverables are provided digitally via email, Google Drive, Dropbox, OneDrive, or the freelance platform's file-sharing system (Upwork, Fiverr). Data Ikseer does not ship physical products.

6.2 Project Timelines

Estimated delivery dates are provided in good faith based on the information available at the start of the project. Timelines may be extended if:

  • The client provides incomplete or delayed information

  • The scope of work changes during the project

  • Unforeseen technical issues or circumstances beyond Data Ikseer control arise

6.3 Delays

If Data Ikseer anticipates a delay, clients will be notified as soon as possible and provided with a revised delivery date. Data Ikseer is not liable for any indirect or consequential losses caused by project delays.

7. Data Confidentiality and Security

Data Ikseer handles all client data in strict confidence. All information shared by clients, including business data, files, and project details, will not be disclosed to third parties except:

  • As necessary to deliver the Services (e.g., using cloud storage platforms like Google Drive)

  • With explicit client consent

  • As required by law or legal process

8. Limitation of Liability and Disclaimers

8.1 No Warranties

Data Ikseer provides Services on an "as is" and "as available" basis. While Data Ikseer strives for accuracy, quality, and timely delivery, Data Ikseer does not guarantee that Services will be error-free, uninterrupted, or meet all specific client requirements.

8.2 Limitation of Liability

To the maximum extent permitted by law, the total liability of Data Ikseer for any claim arising from Services shall not exceed the amount paid by the client for the specific project in question.

Data Ikseer is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities arising from:

  • The use or inability to use Services

  • Errors or inaccuracies in deliverables

  • Unauthorized access to or alteration of client data

8.3 Force Majeure

Data Ikseer is not liable for delays or failures caused by circumstances beyond reasonable control, including natural disasters, pandemics, internet outages, power failures, or government restrictions.

9. Termination and Cancellation

9.1 Termination by Client

Clients may terminate a project engagement at any time by providing written notice via email to contact@dataikseer.com. If a client terminates after work has begun, the client will be charged for work completed up to the termination date, based on the percentage of project completion or hours worked. 9.2 Termination by Data Ikseer

Data Ikseer reserves the right to terminate a project engagement if:

  • The client fails to make timely payments

  • The client breaches these Terms or the Service Agreement

  • Project requirements are unclear or repeatedly change without additional compensation

In such cases, clients will be refunded for any work not yet performed, minus any payments already made for completed work.

10. Freelance Platform Terms

If clients hire Data Ikseer through a freelance platform such as Upwork or Fiverr, these Terms apply in addition to the platform's own Terms of Service. In the event of any conflict, the freelance platform's terms will take precedence for matters related to payment processing, dispute resolution, and platform-specific policies.

Data Ikseer is also bound by the platform's rules and may refer disputes to the platform's resolution process if necessary.

11. Website Use and Cookies

The Data Ikseer website may use cookies to enhance user experience and gather analytics. By using the website, users consent to the use of cookies as described in the Data Ikseer Privacy Policy. Users can control cookie settings through browser settings, but disabling cookies may affect website functionality.

Users agree not to use the Data Ikseer website for any unlawful purpose or in any way that could damage, disable, or impair the website.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Pakistan, without regard to conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from these Terms or Services shall first be resolved through good-faith negotiation between the parties. If a resolution cannot be reached within 30 days, disputes will be subject to the exclusive jurisdiction of the courts in Karachi, Pakistan.

For clients hiring Data Ikseer through Upwork or Fiverr, disputes may be subject to the platform's dispute resolution process.

13. Changes to These Terms

Data Ikseer reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of Services after changes constitutes acceptance of the revised Terms. For ongoing projects, existing Service Agreements will remain in effect unless both parties agree to changes.

14. Entire Agreement

These Terms, together with any Service Agreement, project proposal, or freelance platform contract, constitute the entire agreement between the client and Data Ikseer regarding the Services. These Terms supersede any prior agreements or understandings, whether written or oral.
